In order to implement the reform requirements of "discharge service", improve the government's green procurement policy, simplify the implementation mechanism of government procurement of energy-saving (water-saving) products and environmental labeling products, and optimize the market environment for suppliers to participate in government procurement activities, the relevant matters concerning government procurement of energy-saving products and environmental labeling products are hereby notified as follows:

First, the government procurement of energy-saving products, environmental labeling products to implement item list management. The Ministry of Finance, the National Development and Reform Commission, the Ministry of Ecology and Environment and other departments shall, based on factors such as product energy saving and environmental protection performance, technical level and market maturity, determine the categories of products subject to priority and compulsory procurement by the government and the relevant standards and norms on which they are based, publish them in the form of item lists and adjust them in a timely manner. "Government procurement List of energy-saving products" and "government procurement list of environmental labeling products" will no longer be issued.

2. Implement government priority procurement and compulsory procurement according to item list and certification certificate. Where the products to be purchased by the purchaser fall within the scope of the item list, the purchaser and the procurement agency entrusted by the purchaser shall implement government priority procurement or compulsory procurement of the products that have obtained the certificate in accordance with the certificate issued by the certification body determined by the State and within the validity period of the energy-saving products and environmental labeling products certification certificate.

3. Gradually expand the scope of certification bodies for energy-saving products and environmental labeling products. According to the development status of certification bodies, the General Administration of Market Supervision and relevant departments in accordance with the principle of pilot first, gradual liberalization and orderly competition, gradually increase the implementation of energy-saving products, environmental labeling products certification bodies. Strengthen the relevant certification market supervision, implement "double random, one open" supervision, establish a certification body credit supervision mechanism, and severely crack down on certification violations.

4. Release information of certification bodies and certified products. The State Administration of Market Supervision has organized the establishment of an information release platform for the certification results of energy-saving products and environmental labeling products, and published information about relevant certification bodies and certified products. The certification body of energy-saving products and environmental labeling products shall establish a sound data sharing mechanism and provide relevant information to the certification results information release platform in a timely manner. The Chinese Government Procurement website (www.ccgp.gov.cn) establishes a link with the certification results information release platform to facilitate purchasers and procurement agents to inquire and learn about certification bodies and certified products.

Fifth, increase government green procurement. For the product categories that have been included in the item list, the purchaser may put forward higher requirements for resource conservation and environmental protection in the procurement demand, and give priority treatment to qualified certified products. For the product categories not included in the item list, the purchaser is encouraged to comprehensively consider energy saving, water saving, environmental protection, recycling, low-carbon, renewable, organic and other factors, referring to the relevant national standards, industry standards or group standards, put forward relevant green procurement requirements in the procurement demand, and promote the promotion and application of green products.

6. This Notice shall take effect as of April 1, 2019. The Notice of the Ministry of Ecology and Environment of the Ministry of Finance on the adjustment and publication of the 22nd Government Procurement List of Environmental Labeling Products (Finance [2018] No. 70) and the Notice of the National Development and Reform Commission of the Ministry of Finance on the adjustment and publication of the 24th Government Procurement List of energy-saving Products (Finance [2018] No. 73) were suspended at the same time.
